The Senate Legal Counsel serves as the primary legal advisor to the Senate of the Olbiil Era Kell (OEK), providing expert guidance on constitutional, legislative, and procedural matters. The office ensures that all actions taken by the Senate comply with Palauan law, the Constitution, and established parliamentary rules. Its work supports the Senate’s commitment to lawful governance, sound policymaking, and the protection of public trust.

Role and Responsibilities

The Office of the Senate Legal Counsel provides nonpartisan legal advice to senators, committees, and administrative staff. It assists with the drafting, review, and interpretation of legislation to ensure clarity, consistency, and compliance with existing legal frameworks.

Its key responsibilities include:

  • Drafting and revising bills, resolutions, and amendments upon request from senators or committees
  • Conducting legal analysis of proposed legislation and identifying potential conflicts with existing laws or constitutional provisions
  • Advising on procedural matters during Senate sessions and committee hearings
  • Providing opinions on the legality of government actions, appointments, and executive agreements
  • Assisting in the preparation of treaties, contracts, and memoranda of understanding that require Senate approval

The Senate Legal Counsel operates as an independent office within the Senate Secretariat. In addition, the Legal Counsel provides legal research on emerging issues, helping the Senate anticipate and respond to new challenges in governance, environmental protection, public health, and economic development.

Committees frequently consult the Legal Counsel during hearings and investigations. The Legal Counsel’s office works in coordination with the Joint Staff Office, the Office of Legislative Counsel for the House of Delegates, and relevant government legal departments.
